Apple Pay Terms

These Terms and Conditions govern your use of eligible cards issued by our Issuing Partners (each, a "Payment Card") when you add, attempt to add, or keep a Payment Card in the Apple Pay™ wallet ("Wallet") on any iPhone®, iPad®, or other mobile device ("Device") that supports the Wallet.
These Terms and Conditions also augment existing agreements and represent your agreement with Paytorax Payment Ltd (Wonn Pay) and our Issuing Partners regarding the use of your eligible card account with the Apple Pay service. Within these Terms, “you”, “your”, or “user” refer to the member whose name is located on the Payment Card or any authorized user of the Payment Card. "Wonn Pay", “we”, “our”, or “us” refer to Paytorax Payment Ltd. The Apple Pay service herein includes the Wallet. These Apple Pay Terms and Conditions provided electronically are considered "in writing" and are available to you in a form you may keep at https://wonnpay.com. Enrolling your Payment Card into the Apple Pay service constitutes acknowledgement and agreement to these Terms.
1. Relationship to Apple
The Apple Pay service is a service offered exclusively by Apple using eligible Apple devices. Wonn Pay and our Issuing Partners do not own, operate, or control Apple Pay (including the Wallet), and are not responsible for any service provided to you by Apple or by any third party engaged by Apple. We are not liable for any failure or performance of the Apple Pay service.
Your use of the Apple Pay service is also subject to agreements or terms of use with Apple Inc. or other third parties. Apple and Apple Pay are registered trademarks of Apple Inc.
2. Relationship to Other Agreements
Your enrollment into Apple Pay does not affect other agreements we have with you. Your existing cardholder agreements with Wonn Pay remain fully applicable, including arbitration clauses and fee terms. Any transaction made with a Payment Card via Apple Pay will be treated as if made in person using the physical card.
3. Eligibility
To use Apple Pay, your Payment Card and its account must be in good standing. You must not be restricted from using Apple Pay by Apple, your wireless carrier, or any third-party participant.
4. Device Eligibility
You must use an eligible Apple device, as determined by Apple. Jailbroken or modified devices are not eligible. Use of ineligible devices is prohibited and may result in suspension or termination of Wallet access.

5. Fees
Wonn Pay does not charge any fees for using Apple Pay. You remain responsible for any fees from your mobile carrier, Apple, or other third parties.
6. Suspension of Card in Wallet
We may suspend, block, or cancel your Payment Card's access to Apple Pay at any time for reasons including suspected fraud, loss/theft of device, or legal compliance.
7. Electronic Contact
You consent to receive electronic communications from us related to your use of Apple Pay. You agree to keep your contact information up to date.
8. Data Privacy
By using Apple Pay, you allow us to collect, store, and use data about your use of the Wallet. This is governed by Wonn Pay's Privacy Policy. Apple and other third parties may also access certain Payment Card details, and their privacy policies will apply to such data.
9. Indemnification
You agree to indemnify and hold harmless Wonn Pay and our Issuing Partners from any claims, damages, or losses arising out of your use of Apple Pay or violation of these terms.
10. Limitations of Liability
You are responsible for maintaining your device's security and software. Wonn Pay is not liable for issues arising from device failure, security breaches, or third-party services.
11. Termination or Change
We reserve the right to modify, suspend, or discontinue support for Apple Pay at any time. Continued use of Apple Pay after changes means you accept the updated terms.
12. Your Responsibilities
Enrollment – You agree to follow Apple’s and Wonn Pay’s procedures for enrolling a Payment Card. We may decline enrollment for authentication or risk concerns.
Lost/Stolen Devices – You must promptly report lost or stolen devices or compromised security to us. Delay may increase your liability for unauthorized transactions.
Security – You are solely responsible for safeguarding your Apple credentials and devices.
Account Ownership – You confirm you are the lawful owner of the Payment Card and that all provided information is accurate.
13. Definitions
Apple Pay: Apple’s payment platform that enables device-based card payments.
Apple Pay Service: Use of Apple Pay by you with Eligible Cards on supported devices.
Eligible Card: Cards issued by Wonn Pay’s Issuing Partners and approved for Apple Pay.
Enabled Device: A device authorized by Apple for Wallet use.
Provisioned Card: A Payment Card stored in the Wallet for use in Apple Pay.
Issuing Partners: The licensed financial institutions that issue Payment Cards.
Applicable Law: All governing legal obligations and regulatory requirements.
